Welcome to ASAP’s first podcast on asylum support. This podcast explores two cases which have shaped the current landscape in regards to section 4 eligibility. The first being the case of PA and MA in which Principal Judge Storey found that ending s4 support for those who reside in an area under Tier 3 restrictions (the highest Tier at the time), and are unwilling to leave the UK, may breach their Convention rights and those of the general public (para 48). The second being the case of QBB. This is a judicial review of the lawfulness of the HO’s 15/09/20 policy to evict destitute refused asylum-seekers who refuse to make a voluntary departure from the UK during the pandemic.
Welcome to ASAP’s second podcast on asylum support. This podcast explores section 4 applications. It focus on two cases. The first being KMI. This case is challenging the HO’s policy towards people applying for asylum support. The second being that of AM. On Tuesday 16 March 2021, the Asylum Support Tribunal issued a direction that AM would be a lead case for appeals against refusals of s4 support where the appellant is destitute and they are relying on PA and MA to meet eligibility for s4.
